1、为该工程项目合同纠纷处理提供全流程专项法律服务，服务范围包括法律研判、证据梳理固化、参与相关工作会议提供法律意见、法律函件出具、合同解除协商谈判、诉前调解和解、专项法律意见出具、根据调查核实情况出具尽职调查报告、风险防控指导；诉前保全、司法鉴定协助、矛盾协调等。 2、为本工程项目中的施工总包、基坑施工监测及检测、基坑维护设计、地质灾害评估、方案设计、代建等6个合同的合同纠纷提供全过程特别授权诉讼代理，服务范围包括上述6个合同纠纷的一审、二审、再审、执行、财产保全全流程。受托方全权代为立案、举证、出庭、起草全部法律文书，有权代为承认/放弃/变更诉讼请求、调解和解、上诉、申请执行、签收全部法律文书，全面负责案件争议化解与权益主张，直至案件全部法律程序终结。

1、本项目服务费由诉讼服务费和专项法律服务两部分组成。其中，诉讼服务费24万元，为全流程包干总价，采购人无需额外支付其他费用（法院诉讼费、保全费等行政规费除外）；专项服务费通过计时支付，主任律师800元/小时、专业律师400元/小时，专项服务费上限为6万元，如不超过6万元按实支付，超过部分不再另行付费。 2、付款方式为合同签订后按合同中注明支付方式支付。

（一）在中介集市报名前3个月内存在1次记入一般不良诚信档案行为的；

（二）在中介集市报名前1年内存在2次记入一般不良诚信档案行为的；

（三）在中介集市报名前2年内存在1次记入严重不良诚信档案行为的；

（四）在中介集市报名后中介服务合同签订前，存在记入一般或者严重不良诚信档案行为的

I. One recorded minor bad credit behavior within 3 months before registration in the intermediary market.

II. Two recorded minor bad credit behaviors within 1 year before registration in the intermediary market.

III. One recorded serious bad credit behavior within 2 years before registration in the intermediary market.

IV. Any recorded general or serious bad credit behavior between the registration in the intermediary market and before the signing of the intermediary service contract.

回避情形

（一）参与同一项目采购的不同中介服务机构法定代表人或实际控制人为同一人的；

（二）中介服务机构的法定代表人或实际控制人和委托人单位法定代表人或者项目负责人有配偶、直系血亲（含拟制血亲）、三代以内旁系血亲或者近姻亲关系的；

（三）其他应当回避的情形；

II. The legal representative or actual controller of the intermediary service agency has a marital, direct blood (including presumed blood), collateral blood within three generations, or close in-law relationship with the legal representative or project leader of the entrusting unit.
